Terms and Conditions

The Client (on behalf of itself, its successors, agents, and assigns) gives expressed permission for Weecks Productions, LLC and its agents to commence with the work requested, record, photograph, coordinate/schedule, or otherwise operate at the address listed in the estimate or indicated by Client, or any other requested locations (if applicable). Weecks Productions, LLC will travel one time within a 25 mile radius of Westgate (6770 N Sunrise Blvd, Glendale, AZ 85305) at no charge. For mileage over 50 total miles, $0.85 will be charged (including return mileage). The Client indemnifies and holds Weecks Productions, LLC (including its agents, successors, and assigns) harmless from any and all liability or incident as may result during meetings, creation, pre-production, production, and post-production. The Client hereby releases Weecks Productions, LLC and its agents from any and all liability associated with the Job, including loss-of-video or other incidents which may occur for any reason during a live stream or broadcast.; The Client may use all materials provided to it by Weecks Productions, LLC without further permission, but may not alter any material nor use the materials in any way which would be reasonably viewed as defamatory or libelous to any participant in the video, photographic, or aural recordings. Weecks Productions, LLC retains all copyright on all raw footage, all components, and all resulting products and derivatives, including that it may use its raw and finished product, images, audio, or video of Client or participant(s) and/or locations, and any aspect of the pre-production, production, or post-production processes as part of its own web-based, printed, and other promotions and portfolio. Weecks Productions, LLC may also use the Client’s name and/or company and logo in Weecks Productions, LLC’s portfolio.; Celebration of Life/Funeral/Memorial/Wedding videos and live streams will be recorded or broadcast from the beginning of the commencement of the ceremony until the officiant says or indicates the ceremony has concluded, the ceremony has reached a conclusion published in the printed program, or the Client has advised Weecks Productions, LLC that the ceremony is over; if the ceremony is separate from the committal/burial, etc., Weecks Productions, LLC will not be required to film or stream both events unless otherwise specifically indicated in this estimate. A decedent (when applicable) may, but will not necessarily be imaged. Faces of audiences other than during presentations, speeches, or incidental captures in a group setting will be avoided unless specific request is made by Client, and only if granted in writing by every such subject. In the event that the Client has misrepresented permission to authorize work, there is family disagreement/dissatisfaction about recording or production services once Weecks Productions, LLC arrives at the event, or event is concluded earlier than expected, the above authorized amount will not be refunded for any reason. By paying for this invoice, you agree to the above terms and to indemnify and hold harmless Weecks Productions, LLC and its agents for any moments which are not captured, video and/or broadcast stream technical issues or failures, the content of all video, audio, and/or photographs captured of third parties (for example, attendees who may be recorded saying or doing something considered inappropriate), background noises such as airplanes and wind, Acts of God, stream connection/internet/equipment/playback problems, and all other technical, logistic, or audience related issues which may arise. Client hereby agrees that he/she will not expect a refund for any reason, specifically in the event of any technical issue or failure, such as loss of video signal or broadcast interruption.; Weecks Productions, LLC will use its artistic judgment when providing Services for Client, which may not include strict adherence to Client’s suggestions; Although Weecks Productions, LLC will use reasonable efforts to incorporate Client’s suggestions and desires when providing Client with the Services, Weecks Productions, LLC shall have the final say regarding the aesthetic judgment and artistic quality of the Services. Client dissatisfaction with Weecks Productions, LLC’s aesthetic judgment or artistic ability is not a valid reason for termination of this Agreement or request of any monies returned.; Representatives may have a phone or device out during events and may use earphones for quality assurance.; Due to a variety of factors, Client agrees to indemnify and hold harmless Weecks Productions, LLC and its agents, contractors, employees, and assigns for the final look of any product and/or media including website design, shakiness of video, framing and composition, color balance, audio quality and volume, and overall appearance of video or pictures.; The estimated total price is subject to increase in the event of change orders, approved overtime, or additional requests beyond customary editing. Approved over time is the scheduled service(s) taking longer than the quoted amount of time for any reason outside of the control of Weecks Productions, including events running late and/or client requests.; If after 3 business days of Weecks Productions, LLC delivering a draft (when applicable) and the Client has not responded with corrections, comments, or to approve the product (this is not applicable to social media management contracts), the Job will be deemed complete to the Client’s satisfaction and the Client will be presented the final invoice. Payment of outstanding balances will be required in full upon delivery of the invoice which must be paid within 72 hours and prior to receiving any final work product (when applicable); after 7 days of non-payment, a late fee of $35/day will be added to total amount due. Client will be responsible for collection costs and any other applicable fees if Client refuses to pay any final outstanding balances.; For any post-production jobs, Client will have the option to provide 2 sets of minor corrections or comments once presented with the proof(s), if applicable. If the requested corrections are minor (meaning each “change” requires 30 minutes or less total to complete all changes), Weecks Productions, LLC might not charge as a client courtesy but anything that takes over 15 minutes, any graphic/motion design, or requested in-person meetings will be considered a change order and will be charged at $95 per hour, per change order.; For any live/social media work, one hundred percent of the estimated total including estimated TPT tax is due upon approval of this estimate prior to the start of any work or scheduling. All other clients will be required to pay a down payment of 75% of the subtotal, all TPT tax, and any anticipated expenses prior to the commencement of any work, and the remaining 25% with any outstanding balances upon receipt of the final invoice once Weecks Productions, LLC has fulfilled its contract.; Any further sums due to increased cost or change orders will be due in full prior to the delivery of an unwatermarked final product when applicable, or due in accordance with payment terms on final invoice. Thank you for understanding that preparation by Weecks Productions, LLC begins upon receipt of the signed estimate and initial payment collection. Therefore, the full payment is not refundable for any reason. The balance is due (including but not limited to any increases due to change orders, additional requests beyond customary editing, overages in event timing (e.g. events running late), travel charges, collection or other fees, incurred expenses, or other relevant price increases) upon receipt of the final invoice per the payment terms listed on that invoice. Any disputes shall be resolved in the greater metropolitan Phoenix area and interpreted under Arizona law.
